Government looks for options to UNMIN

The government is seriously mulling an alternative to UNMIN which has been monitoring the arms and armies of Nepal Army (NA) and the People’s Liberation Army (PLA) since 2007. Towards that end, it has started consultations with government officials and major political parties. Political parties have been sharply divided on whether the UN political mission should be given a new extension after September, with leaders of the Nepali Congress and CPN-UML supporting the Army’s position that UNMIN should leave in September. The Maoist party, however, has reacted strongly against the suggestion, saying that such a move would lead to the end of the already-perilous peace process. Prime Minister Madhav Kumar Nepal on Monday consulted with senior government officials and decided to hold follow-up meetings with major political parties “very soon.” Foreign Minister Sujata Koirala, Nepal’s Permanent Representative to the UN Gyan Chandra Acharya, Chief Secretary Madhav Ghimire and Foreign Secretary Madan Kumar Bhattarai were among those present in a meeting called by the prime minister in the evening.  “Apart from the Maoists, none of the political parties seem willing to give another term to UNMIN. The prime minister directed the mandarins of the Ministry of Foreign Affairs to look into various international experiences and that of UN’s political missions elsewhere,” a senior official told the Post. The prime minister will also seek the opinion of the diplomatic community in Kathmandu, including from those whose countries are represented in the UN Security Council and India very soon. “He will hold a meeting with major parties before taking a final call,” said Press Advisor to the prime minister, Bishnu Rijal. In case of UNMIN’s exit, the Special Committee for the Supervision, Integration and Rehabilitation could be given the role of supervision and monitoring. Nepal’s position on UNMIN is being closely followed at the UN headquarters in New York where the 65th General Assembly (UNGA) takes place next month. Nepal is contesting in the crucial presidency of the GA. anwhile, the Nepal Army has intensified discussions with senior government officials and non-Maoist parties represented in the the Special Committee for the Supervision, Integration and Rehabilitation of Maoist combatants regarding the fate of UNMIN.  “Army chief Gen. Chhatra Man Singh Gurung has handed over a three-page paper against UNMIN to the members of the Special Committee,” said a senior party official. “It argues why UNMIN should be removed from Nepal and questions its impartiality.” The paper suggests that the Special Committee would be the right body to replace the UN political mission. Gen. Gurung held discussions with Special Committee Chairman Prime Minister Madhav Kumar Nepal and its members Ishwor Pokharel (CPN-UML), Ram Sharan Mahat and Minendra Rijal (both from the Nepali Congress). Five Killed in Landslide, Floods

At least five persons were killed due to floods and landslides triggered by heavy rainfall in many parts of the country on Monday. Two persons were swept away by rivers in Sindhuli district yesterday. The deceased have been identified as 17-yr-old Yunita B.K. of Jarayotar and Baubalal Kumar of Dudhauli. Similarly, one Bhim Khati was swept away by the swollen Garuwa rivulet in Ilam. Meanwhile, a woman has been killed and three others injured in a landslide that took place at Gotri VDC-5 of Bajura district on Monday, according to state-owned news agency RSS. The deceased has been identified as Laxmi Singh, 45, who was looking after her cattle when the incident took place. Similarly, landslide buried Laisi Chepang in Kakada VDC-7 in Makwanpur district. Nepal National Pavilion at the Global Exhibition 2010

There is a high chance that the Nepal National Pavilion at the Global Exhibition 2010 being held in Shanghai, China, will be included among the top ten best pavilions, reports Rastriya Samachar Samiti (RSS). This premise has been bolstered by the popularity the Nepal National Pavilion has been gaining at the exposition. The exhibition showcases the economic, social and technical progress of 189 countries, including Nepal and over 50 multinational companies that are participating in the event. The Nepal Pavilion which has a unique feature has attracted the attention of the world community and generated a lot of interest among the visitors there. "The possibility of the Nepal Pavilion coming among the top ten best pavilions has increased day by day going by the popularity it has been gaining among the visitors," Amrit Shakya, director of the Implementing Experts' Group, said. The Group constructed the Nepal Pavilion at the World Exhibition in Shanghai with the approval and cooperation of the Government of Nepal. The building materials were designed by the craftsmen in Nepal and it took them four years to complete the work. The building materials comprising artistic woodcraft, metal craft, stone sculptures and traditional bricks and tiles for the Nepal Pavilion weighing more than 500 tonnes were taken to Shanghai from Kathmandu. Chairman of the Special Court, Gauri Bahadur Karki and judges Om Prakash Mishra and Kedar Prasad Chalise grilled the duo. A visibly nervous Karki pleaded innocence and said his own party men were behind the “drama.” “I have been framed for my close rapport with UML leader Bam Dev Gautam—who is considered a hardliner in the UML—and his clear stance against federalism,” Karki told the court. Investigators, however, have it that Karki was the mastermind of the bribery racket. He duped people when Gautam was the Minister for Home Affairs in the past. Sources said police had been keeping an eye on him for some time after receiving complaints from victims. Karki had reportedly demanded Rs. 500,000 from the victim who was vying for the post of an Inspector. The victim, who had paid Rs. 100,000, lodged a complaint with the code number of the currency notes he had given to Karki. This subsequently landed him in trouble. Karki said he would bring out the truth before the media once he secures his release. On the other hand, Swami said he was bound to be arrested. “I made a mistake. I did not realise that I was doing the wrong thing,” he told the judges. On hearing the confession, the court granted permission to the CIAA to keep the duo in judicial custody for 20 days. Dhir Bahadur Chand, registrar of the court, said the CIAA chargesheets were not clear on whom the bribe money was recovered from. A special police team led by SP Birendra Shrestha arrested the duo red-handed from a rented accommodation at Bhimsengola. Karki was elected through the proportional system from Syangja. The CIAA also wrote a letter to Speaker Subas Nembang asking him to help take action against Karki. According to sources, Nembang telephoned UML Chairman Jhala Nath Khanal and asked him to demand Karki’s resignation. The CPN-UML has formed a three-member committee to investigate Karki’s involvement in the case. Central Disciplinary Commission Chairman Amrit Kumar Bohara said the party will take action against him as per the committee’s report.

Rescue workers had used an excavator to look for the black box. The recovered equipments are vital for the investigation into the cause of the crash.

The five-member probe committee formed to investigate Agni airplane crash in Makwanpur last week began its work from Sunday. The committee members visited the crash site at Shikharapur of Makwanpur district today and requested local authority to expedite the search for cockpit voice recorder (CVR) and flight data recorder (FDR), which have not been found despite frantic search. According to Suresh Acharya, the committee's spokesperson, the panel has also made an announcement of cash reward of rupees 50,000 to anybody finding those vital equipments. Headed by aviation expert Kumar Prasad Upadhyay, the committee is comprised of Acharya, Rajan Pokharel, Sharada Bhakta Rajbhandari and Rajendra Man Shakya. The committee has been given 65 days to submit the probe report. APF gives cash incentive to first person to inform about crash Meanwhile, Armed Police Force (APF) has provided Rs 5000 as incentive to Bhaktaraj Shyangtang, a local of Bastipur in Shikharapur VDC, Makwanpur, where an Agni Air's dornier 228 crashed last week for informing the APF about the crash promptly, Shyangtang had informed APF Assistant Inspector General (AIG) Shailendra Kumar Shrestha about the crash few minutes after the crash. APF regional headquarters in Pathlaiya had dispatched a 35-member rescue squad immediately to crash site. The rescue squad was stationed in the crash site till Sunday morning.

A senior aviation official has said that the tragic air plane crash that occurred Tuesday morning, which killed all 14 aboard, could have been averted had the air line operator (Agni Air) taken note of the bad weather in Kathmandu and across the country from the past few days due to the monsoon season. He said that the weather was not at all appropriate to operate flights today. The aviation official, K.B Limbu, who is the General Manager of national flag carrier Nepal Airlines Corporation (NAC), further said that although the bad weather could have been one of the leading causes that contributed to the crash, there could very well be other reasons behind the tragedy which will be known after the probe committee formed to investigate the crash comes up with its report. In an interview with a local television news channel this afternoon, he also said that the domestic airline companies are sometime pressured by the passengers to operate the flight even during bad weather. Limbu, however, also admitted that a developing country like Nepal may not always have a very effective monitoring mechanism to check if the domestic airline companies operating flights to various parts of the country are taking all the necessary safety precaution to avert this kind of tragedy. From the past one week, a thick cloud of mist has shrouded Lukla airport, the gate-way to the Everest region and home to world's tallest peak Mt. Everest. Flights to the remote mountainous region had been cancelled or delayed many times in the past few weeks because of bad weather which is common during monsoon season.



Weather experts also confirm that the weather was not suitable for flights today.

The political controversy over the ongoing recruitment drive of Nepal Army (NA) is one thing, but the response from youths to its vacancy announcement has been fairly huge. According to the Directorate of Public Relations of the NA, 57,513 applications were filed for 3,464 positions including 250 officer-level positions. 8,703 applicants turned up for 250 officer-level positions including 791 women while 48,810 applications were filed for other positions. This was for the first time the NA allocated reserved seats for women, indigenous community, Dalits, Madhesis and backward regions. Of the 250 officer-level positions, 22 positions were allocated for women, 36 for indigenous community, 32 for Madhesis, 17 for Dalits and 6 for backward regions.  However, the response from Madhesis to the army job was the poorest with only 187 applications received for 154 officer cadets while there were 999 applications for 404 other positions. The number of applications from indigenous people, women, Dalits and backward regions was 1287, 791, 187 and 105 respectively. The NA collected Rs. 16.93 million revenue from the applications, according to the DPR. The NA had published vacancy notices on August 2 following the Supreme Court ruling that quashed a writ petition against its fresh recruitment drive. The recruitment drive started amid dispute with the UCPN (Maoist) opposing it, saying the NA misinterpreted the apex court ruling which stated that the issue should be settled through the Joint Monitoring Coordination Committee (JMCC), an UNMIN-chaired body which comprises representatives from both the NA and the Maoist army. The Maoists had also threatened to start recruitment in their People's Liberation Army (PLA) if the NA did not stop the process.

The body of Nirmala Shrestha, 35, of Nepalgunj-2, Banke, was found in Tulsi Hotel in Lucknow hotel three days ago. Police have arrested Sonu Haluwai in connection with the abduction and subsequent murder of Shrestha. During police interrogation, Haluwai confessed that he kidnapped Shrestha with the help of two of his friends - Akram Haluwai and Raphik Behana - and took her to Luknow. Police have arrested chief of District Livestock Services Office, Morang, Dr Udaya Pratap Singh, on charge of molesting a female sub-ordinate. Morang police arrested Singh on Monday based on a complaint of molestation filed by a former female employee of the Livestock Services Office. The woman had filed a complaint on Sunday saying Singh had been molesting her since she joined office in April and had recently fired her from job showing fault in her performance. Singh had been absconding following the complaint. The Regional Livestock Services Office, Biratnagar has suspended Singh from his post following the allegations. Earlier, chief of the Regional Livestock Services Office, Dr Yogendra Yadav, had tried to mediate a consensus between the female employee and Dr. Singh to save the office from embarrassment. Ncell is all set to return the amount it had charged to its subscribers during the Ncell's "Dial 9090 lucky draw campaign". Nepal Telecom Authority (NTA) had suspended Ncell's Dial 9090 lucky draw asking for the clarification about the tariffs it had charged to its customer against the NTA regulation. Ncell is all set to refund the amount to its customers who have participated in the lucky draw campaign, Sanju Koirala, Corporate Communication Manager of Ncell, told Nagarik Daily. NTA has permitted tariff of Rs. 1.99 per minute (exclusive of tax) while the Ncell had charged Rs. 2.47 (inclusive of tax) for 10 seconds under the lucky draw campaign. Koirala also told Nagarik daily that they have been holding meeting with the authority and if they are authorised, the new scheme will be continued. Ncell had started the new scheme from August 27, 2010 with attractive prizes but it had to suspend the scheme after just five days. Nagarik Daily quoted a source as saying that within the period of five days over 500,000 subscribers had participated in the lucky draw campaign. Koirala also informed the daily that the money will be refunded within a few days as there may be some technological problem while refunding amount to its subscribers in one day. No candidate likely to be elected as PM in today's election

Going by the developments so far, it is likely that today’s election will not bring any outcome and the parliament will announce a date for another election. However, if the events take a dramatic turn as it happens in Nepalese politics quite often an unforeseen outcome might come. CPN (UML) forwarded its candidacy with the condition of securing two-thirds majority at the House. The party has instructed PM candidate Khanal to have at least 401 lawmakers to agree in black and white before the beginning of the House meeting. This is possible only if Maoist candidate Dahal withdraws his candidacy in support of Khanal and the Madhes-based parties also support Khanal. The Maoists currently have 237 seats in the parliament, UML has 108 seats and the Madhes-based parties jointly have over 80 seats in the parliament. If the Maoists and the Mades-based parties support him, Khanal will have a two-thirds majority in the parliament. Although undecided so far, the possibility of Maoists withdrawing their candidacy has not ended. Party vice chairman Narayan Kaji Shrestha had told the reporters after filing Dahal’s nomination yesterday, we might not stick to the decision (to field Dahal for PM race) of the politburo due to the UML decision (to field Khanal for PM race). A faction of Maoists had earlier said, they would support Khanal if UML fields him as a candidate. They had waited for a long time for the UML decision before deciding on Dahal’s candidacy. The Maoists have also decided to run in the elections anyway if a simple majority is ensured. Maoists can secure a simple majority if the Madhes-based parties support them. The Madhes-based parties, which have formed an alliance and decided to support a party that shows commitment to the cause of Madhes, have kept mum so far. The UML has decided not to vote for any candidate if its candidate is required to back-out for not securing assurance of more than 401 lawmakers. Nepali Congress candidate Ram Chandra Poudel is almost certain to lose in the elections today. Madhesi Janadhikar Forum Nepal (MJF-N) breached the alliance with other three Madhes based parties, but did not participate in the voting process. Madhesi Janadhikar Forum (Loktantrik) lawmakers did not turn up at all for the voting. MJF-N, whose leaders had said earlier they would vote for Maoist candidate Pushpa Kamal Dahal, changed their mind at the last moment after they saw their votes alone would not be sufficient for the Maoist candidate to get a majority. Speaking to journalists after the votings MJF-N lawmakers said, we went to the House prepared to vote for the Maoist candidate, but changed our mind when lawmakers of decisive MJF-L did not turn up for voting.  Hence, the prime ministerial election on Tuesday also ended in a fiasco. Nepali Congress vice president Ram Chandra Poudel secured 119 votes in his favour while 245 votes were cast against him. Some 151 lawmakers opted for 'no vote' section in the ballot paper. Altogether 515 lawmakers participated during the voting. Likewise, Maoist chairman Dahal also failed to secure majority (301 votes) receiving 240 votes in his favour while 110 votes were cast against him. Some 159 lawmakers opted for 'no vote' section in the ballot paper. Altogether 521 lawmakers participated during the voting. Next election on September 26 As both the prime ministerial candidates failed to get elected by today's election, Speaker Subash Chandra Nemwang announced that the next election would take place on September 26 as per the recommendation of the Business Advisory Committee.

As many as 3088 representatives are going to participate in the 12th general convention of the Nepali Congress to be held in Kathmandu September 17-25. Siutala informed that the number of active party members has grown to 312,483 now. The inaugural ceremony of the general convention will be held at Khula Manch and the close-door session will be organised at Bhrikuti Mandap. According to Situala, the party has started booking hostels and guest houses at Sundhara, Thamel, Gaushala and Bagbazaar areas to accommodate the general convention representatives while meals will be arranged at the venue, Bhrikuti Mandap.

Nepali man arrested for rape in Australia; lawyer contest it was consensual

A Nepalese man who was delivering a takeout Indian meal to a woman´s home has been accused of sexually assaulting her, the Associated Press reports. Amit Hamal appeared in a Sydney court on Tuesday charged with having sexual intercourse without the woman´s consent last week. Hamal is accused of entering the house through an unlocked door and assaulting the woman, who had been asleep in her bedroom. Hamal´s lawyer says the sex was consensual. Hamal was arrested at Sydney airport on Monday night as he was boarding a flight to Bangkok. The judge has refused bail and adjourned the case until July 29.
